Welcome to The Narrative Graph ("Service", "we", "us", or "our"), operated by The Narrative Graph. These Terms of Service ("Terms") govern your access to and use of our website, software, applications, and artificial intelligence-powered tools for manuscript analysis, narrative graphing, and content generation.

PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING, REGISTERING FOR, OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.

NOTICE ON DISPUTE RESOLUTION: THESE TERMS CONTAIN A BINDING ARBITRATION CLAUSE AND A CLASS ACTION WAIVER (SECTION 12) THAT AFFECT YOUR RIGHTS TO RESOLVE DISPUTES WITH US.

1. ELIGIBILITY AND ACCOUNT REGISTRATION

1.1. Eligibility: You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent that you are not barred from using the Service under applicable laws.

1.2. Account Security: You agree to provide accurate, current, and complete information during registration. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized access at support@thenarrativegraph.com.

1.3. Account Termination: We reserve the right to suspend or terminate your account at our sole discretion if we suspect fraud, violation of these Terms, or strictly to protect the integrity of the Service.

2. DESCRIPTION OF SERVICE AND AI LIMITATIONS

2.1. The Service: The Narrative Graph is a SaaS platform providing AI-assisted tools for writers, including manuscript upload, narrative analysis, graphing of story elements, content generation suggestions, plagiarism detection, and IP auditing.

2.2. AI Nature (Hallucinations): You acknowledge that the Service uses Artificial Intelligence ("AI") models. AI is probabilistic and may produce "hallucinations," inaccuracies, non-factual information, or offensive errors. The Service is a tool to assist human creativity, not a substitute for human judgment. You are solely responsible for reviewing, editing, and verifying any AI-generated text before publishing.

2.3. Plagiarism & IP Auditing Tools: Our features for plagiarism checking and content auditing are provided on a "best-effort" basis. We do not guarantee that these tools will detect all instances of plagiarism or copyright infringement. You verify that your content is original and compliant with the law independent of our tools.

2.4. Service Modifications: We may modify, suspend, or discontinue any part of the Service (including specific AI models) at any time without notice or liability.

2.5. Data Backup: The Service is not a data storage or backup service. While we use industry-standard infrastructure (Google Cloud Platform) to secure data, you agree that you are solely responsible for maintaining independent backups of your User Content and manuscripts. We are not liable for any loss or corruption of data.

3. SUBSCRIPTION, BILLING, AND CREDITS

3.1. Payment Processor (Paddle): Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. By subscribing, you authorize us and Paddle to charge your payment method for all applicable fees and taxes.

3.2. Subscriptions: Subscriptions automatically renew at the end of each billing cycle unless canceled at least 24 hours prior to the renewal date.

3.3. Credit System (Words/Tokens):

  • Allocation: Service usage is measured in credits (e.g., words generated or processed). Credits are allocated monthly based on your plan.
  • Expiration (No Rollover): Unless explicitly stated in your specific Plan description, unused credits expire at the end of the billing cycle and do not roll over to the next month.
  • No Cash Value: Credits are not currency and strictly represent a license to use the software. They are non-transferable and non-refundable.
  • Overage: If you exceed your plan's limit, you must purchase an add-on pack or upgrade your plan to continue generating content.

3.4. Cancellation: You may cancel your subscription at any time via your account dashboard. Access remains active until the end of the current billing cycle.

3.5. Refund Policy:

  • 14-Day Money-Back Guarantee (Initial Subscription): We offer a full, unconditional refund within fourteen (14) days of your initial purchase. If you are not satisfied with the Service for any reason during this first period, please contact us at support@thenarrativegraph.com, and we will issue a full refund, regardless of your usage.
  • Renewals: The 14-day refund right applies strictly to the initial subscription purchase. Automatic renewals are non-refundable. You are responsible for canceling your subscription before the renewal date if you do not wish to continue using the Service.
  • Credit Restitution ("Word Refund"): Independent of monetary refunds, we offer credit restitution for specific unsatisfactory AI generations (e.g., gibberish or technical error). If you encounter a generation error, we may restore the credits used for that specific task. This is limited to a maximum of 5 requests per billing cycle. These refunds restore credits to your account balance only and have no monetary cash value.

4. INTELLECTUAL PROPERTY RIGHTS

4.1. Your Content (Input): You retain all ownership rights, including copyrights, in any manuscripts, texts, or data you upload ("User Content").

4.2. AI Output Ownership: Subject to your compliance with these Terms, The Narrative Graph assigns to you all its right, title, and interest in the Output generated by the AI for you. You are free to use the Output for commercial purposes.

4.2.1. No Guarantee of Copyrightability: You acknowledge that under current U.S. laws, content generated exclusively by AI without significant human creative input may not be eligible for copyright protection. The Narrative Graph makes no representation or warranty regarding the copyrightability or enforceability of rights in raw AI outputs. You are solely responsible for adding sufficient human creativity to the Output to secure intellectual property rights.

4.3. License to Us: You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and process your User Content solely to provide the Service to you (e.g., to generate the graph).

4.4. AI Training (Privacy Protection):

  • User Content: We do not use your written stories or manuscripts to train our foundation artificial intelligence models.
  • Aggregated Data: We may use anonymized, aggregated usage data (e.g., "how many users use the graph feature") to improve the Service functionality, but this does not include the text of your stories.

5. ACCEPTABLE USE POLICY (AUP)

You agree not to use the Service to:

  • Generate content that promotes illegal acts, child sexual abuse material (CSAM), or non-consensual sexual content.
  • Reverse engineer, decompile, or attempt to extract the source code or underlying models of the Service.
  • Attempt to bypass plagiarism checks, word limits, or credit counting systems.
  • Engage in automated scraping or "data mining" of the Service.
  • Use the Service to build a competing product or dataset.
  • Engage in excessive usage or automated calls that significantly exceed the average usage patterns of other users or that otherwise burden the Service’s infrastructure. We reserve the right to throttle or temporarily suspend accounts that trigger such excessive usage, regardless of available credits.

6. DMCA COPYRIGHT POLICY

We comply with the Digital Millennium Copyright Act (DMCA). If you believe your work has been infringed, notify our Agent:

  • Description of the copyrighted work;
  • Description of the infringing material and URL;
  • Your contact info;
  • A statement of good faith belief; and
  • A statement under penalty of perjury that you are authorized to act.

7. FEEDBACK

If you provide us with any feedback, feature requests, or suggestions regarding the Service ("Feedback"), you acknowledge that we own such Feedback and may use it for any purpose without obligation or compensation to you.

8. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT: (A) THE AI OUTPUT WILL BE ACCURATE, ORIGINAL, OR FREE OF ERRORS; (B) THE SERVICE WILL BE UNINTERRUPTED OR SECURE; OR (C) THE PLAGIARISM CHECKER WILL DETECT ALL SIMILARITIES.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE NARRATIVE GRAPH, ITS AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. INDEMNIFICATION

You agree to indemnify and hold harmless The Narrative Graph from any claims, damages, liabilities, and expenses (including legal fees) arising out of:

  • (a) Your use of the Service;
  • (b) Your violation of these Terms;
  • (c) Your violation of any third-party rights; or
  • (d) Any claim that your User Content or the AI Output generated by you causes damage to a third party.

11. TERMINATION

11.1. By You: You may stop using the Service at any time.

11.2. By Us: We may terminate or suspend your access immediately, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Service, us, or third parties, or for any other reason.

11.3. Survival: Provisions regarding IP ownership, Disclaimers, Liability, and Indemnification survive termination.

12. DISPUTE RESOLUTION AND CLASS ACTION WAIVER

12.1. Governing Law: These Terms shall be governed by the laws of the State of California, USA, without regard to conflict of laws principles.

12.2. Binding Arbitration: Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA). The arbitration shall be conducted in the English language.

12.3. Class Action Waiver: YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. Disputes must be resolved on an individual basis.

12.4. Exception: Notwithstanding the above, either party may seek injunctive relief in a court of competent jurisdiction to protect its intellectual property rights.

13. MISCELLANEOUS

  • 13.1. Severability: If any provision of these Terms is unenforceable, that provision will be modified to reflect the parties' intention or eliminated to the minimum extent necessary, and the remaining provisions will remain in effect.
  • 13.2. Entire Agreement: These Terms constitute the entire agreement between you and The Narrative Graph.
  • 13.3. Force Majeure: We are not liable for any delay or failure to perform resulting from causes outside our reasonable control (e.g., acts of God, war, internet outages).
  • 13.4. No Waiver: Failure to enforce any right does not constitute a waiver of future enforcement.
